Testing for DUI Blood Alcohol Test
Reader’s Question:
My son got arrested for DUI here in Arizona a few days ago. My immediate concern is how the arresting officer took a test of his blood alcohol content. The officer was the one who drew blood from my son for testing. Are they allowed to do that? Isn’t it better if they took him to a hospital or clinic for a specialist to take the blood sample and do the test?

Having Arizona police officers draw blood from drivers suspected of DUI for BAC levels is the subject of much scrutiny in the state. Under the Arizona DUI law, a suspect for drunk driving should submit BAC test or face a 12-month suspension of his or her driver’s license. DUI law in Arizona actually makes it the officer’s choice to administer either a breath or blood test.
What may not be known to some people is that Arizona law enforcement officials have been drawing blood from suspected DUI drivers for years. They said that this policy is much more efficient than requiring an officer to drive to a hospital for a blood test. Arizona police also reports that blood tests are much more accurate than breathalyzer tests.
There was already a reported personal injury claim stemming from this method after a man developed an infection at the site of where his blood was drawn.
Arizona DUI lawyers have argued that suspected DUI offenders are being put at unnecessary risks by this policy of police officers drawing blood.
